USCIS Resumes H-1B Premium Processing for Certain Cap-Exempt Petitions

On July 24th, 2017 United States Citizenship and Immigration Services stated it would resume premium for premium processing for specific cap-exempt H-1B petitions, effective immediately.

The types of petitions that may be exempt from the H-1B cap include:

  • An institution of higher education
  • A nonprofit related to or affiliated with an institution of higher education; or
  • A nonprofit research or government research organization

USCIS states that premium processing will additionally resume for petitions that may be exempt if the beneficiary will be employed at a qualifying cap-exempt institution organization or entity.

This news comes after a March 3rd, 2017 notice that USCIS would temporarily suspend premium processing for all H-1B Petitions starting April of this year.

USCIS additionally states that it plans to resume premium processing of other H-1B petitions not identified in this notice “as workloads permit.” Until then, premium processing remains suspended on all other H-1B petitions.
